These General Terms and Conditions apply to German training providers which would like to be included in the iMOVE database.
- Recognition of quality standards
The training organisations which are registered in the iMOVE database shall be obligated to uphold and adhere to the quality standards of the iMOVE continuing training database.
- Data protection
Statements about your enterprise which you make during the registration process are solely for checks and controls performed by iMOVE and shall not be passed on to third parties. iMOVE shall be entitled, however, to store content and pass such on to third parties if such is required by law or deemed to be necessary to fulfil obligations in order to (1) conform to legal provisions, court or official government orders, (b) to enforce these General Terms and Conditions, (c) to react to a claim that rights have been violated by a third party or (d) defend the property or security of iMOVE, its users or the public. We note that the technical preparation and transfer of offers, including the content you have entered, could make it necessary (a) to undertake transfers via various networks and/or (b) make changes in order to conform to technical requirements of affiliated networks or other technical facilities.
- Account, password and security
After registration you will be issued a password and a name for your account. You must ensure that the password and account are not made available to a third party and shall bear full responsibility for all actions which are undertaken using your password or your account (including by other persons). You shall be obligated to notify iMOVE without undue delay as to any and all abuse of your password or account as well as any and all violations of security provisions. You must also ensure that you leave your account each time you are finished using it. iMOVE excludes all liability for any losses or damage which you may incur due to failure to adhere to these obligations.
- Link-up
The educational and training facilities registered in the iMOVE database herewith declare their willingness to have a reference made on their website to the home page of the iMOVE database via an HTML hyperlink. One can choose between a pure textlink or a textlink with a graphics. Graphics (banners and buttons) and the linkcode these are based on shall be provided by iMOVE. Reference should be made on a site at the first or second level. The link-up must be executed within six months after the provider has been registered in the iMOVE database.
- Responsibilities of the participating training facilities
Responsibility for the content which you enter (upload), publish, send by e-mail or pass on in any other manner within the framework of the services shall be solely borne by you or the company from such content originates. iMOVE shall not be liable for content, in particular for errors, incorrect or incomplete information in connection with content, nor for any loss or damage which emanates from use of content.
To guarantee the quality of the uploaded content to the greatest extent possible, iMOVE expressly retains the right to reject particular content which is available via the database and to exclude such in whole or in part from publication.
This shall apply in particular to the following prohibited content:
- Content which constitutes disguised advertising, chain letters or surveys;
- Content which is non-objective or untrue;
- Content of a pornographic, immoral or other objectionable nature;
- Content which is anti-constitutional, politically extremist or which emanates from prohibited groups or organisations;
- Content which is penalisable, in particular inciting or insulting;
- Content which may impinge upon, damage or destroy software or hardware, in particular content containing viruses.
iMOVE retains the right to correct incorrect statements in the offers and profiles of providers.
- Release from liability
You herewith declare that you release and indemnify iMOVE from any liability with regard to any and all claims which are forwarded by third parties as a result of or in connection with content which you upload, publish or transfer within the framework of the service or as a result of your use of the service, your connection to the service or as a result of your violation of these General Terms and Conditions or rights of third parties. This shall also apply to reasonable expenses for legal counsel.
- Termination
Your account can be deleted at any time upon request. You agree that iMOVE can terminate your user password, your account (or parts thereof) or any other use of the services by yourself and delete any and all content as iMOVE sees fit. This shall in particular apply if you have not used the services for an extended period of time or if iMOVE assumes that you have not adhered to the basic principles set out in the General Terms and Conditions. You also agree that iMOVE cannot be held liable towards you or third parties for the termination of access to the services. In the event of your account being deleted, you may only receive access to the database again with the prior written consent of iMOVE.
- Links
As user of the iMOVE continuing training database, you can create links to your websites or sources. iMOVE is not responsible or liable for the availability of such external sites or sources, does not make content which is available at or via such sites or sources its own and excludes all liability or warranty with respect to such. iMOVE can for this reason not be held directly or indirectly responsible either for damage or loss resulting from or in connection with the use of content or by relying on such content which is downloaded via such external sites or sources.
- Exclusion of warranty
Persons use the database at their own risk. The services are offered in the form which is respectively considered good by iMOVE and subject to the proviso of availability. iMOVE does not guarantee that the services made available correspond to requirements and are available at all times without interruption, in due time, secure or free of error. iMOVE shall not assume any warranty with regard to the results which can be achieved through use of the services in respect of the correctness and reliability of the information received within the framework of the services or for the quality of goods, services or information received in connection with the services conforming to your expectations. Nor does iMOVE guarantee that the hardware and software used for the services will work free of error at all times or that possible hardware or software errors will be corrected.
- Changes in these General Terms and Conditions
You shall be separately notified as to any changes or additions to these General Terms and Conditions. The changed or amended General Terms and Conditions shall only apply when you use the database of iMOVE once again after receiving this notification.
